Personal injury may include both physical and emotional harm suffered as a result the negligence of another person, business or entity. To succeed you must prove: 1) that the person or entity had a DUTY to act; 2) that the person or entity's conduct fell below the standard of reasonable care, thereby constituting a BREACH 3) that the breach CAUSED injuries; and 4) DAMAGES. If property is damaged together with a personal injury, then unresolved property claims can be included in a personal injury lawsuit. In some cases it may be necessary to file a lawsuit so as to secure the maximum compensation for the effects that the injury or injuries have had, and may continue to have, on one’s life and livelihood. Successful personal injury awards include compensation for special damages and general damages. Punitive damages may also be awarded as punishment to deter reckless and wanton conduct of the person, business or other entity - and others like it.

Personal injury lawsuits can include motor vehicles of various types including automobiles, motorcycles, and boats. Other types of cases involve pedestrian accidents, dog bites, medical malpractice, wrongful death, products liability, defective drugs, slip and falls, birth injuries, environmental accidents such as defective buildings, exposure to toxic materials or damaging substances, and defective and/or poorly designed roads, or traffic control devices conditions.

Who can file a personal injury lawsuit?
The lawsuit is usually filed on behalf of the injured person.  However, if the injury resulted in death or the victim is not competent, the lawsuit can be filed by a family member or legal guardian. Sometimes a person who is indirectly affected by the injury may have a standing, such as a spouse. An experienced personal injury attorney can help you determine who should file the lawsuit. Contact attorney David J. Wolf immediately for a free case evaluation.

How long do I have to file a personal injury lawsuit?
In Arizona the statute of limitations for most claims is two years from the date of injury to file a lawsuit. If the State is the defendant a notice of claim must be filed within 6 months and a lawsuit must be filed within 1 year.  These limitations are subject to change and therefore should not be relied upon without first contacting an experienced personal injury attorney for verification as quickly as possible after the injury has occurred. If you do not comply with the applicable statute of limitations, you will forever be precluded from recovering any money from the responsible party.

Should I talk to the insurance representative that keeps calling?
It is highly recommended that you contact an attorney before deciding whether or not to talk with any insurance company about the facts of the accident and any health issues.  Once you have engaged an attorney, it is best to refer all calls to the attorney’s office.  Experienced personal injury attorneys will ensure that you are not pressured by an insurance company and that your rights are protected.

If you or someone you know has suffered an injury, it is important to take these steps RIGHT AWAY:
  1. Seek immediate medical attention.
  2. Report the accident to the police if needed.
  3. Contact our law firm for experienced representation and guidance on how to proceed.
  4. Take photos of your injuries and any damaged property and develop the photos immediately to ensure that they accurately represent the injury or damage.
  5. Collect any physical evidence such as clothing you were wearing or broken items. Keep receipts for items purchased.
  6. Continue with all follow up medical treatments on schedule as advised by a doctor.
  7. Obtain a doctor’s note for all time off of work.
  8. Do not speak to anyone about the accident.
  9. Do not give a written or recorded statement to an insurance representative either in person or over the phone.
  10. Make notes for yourself and your attorney.
